Terms of Service

Welcome to PeakPawsTag. These Terms of Service ("Terms") govern your access to and use of the PeakPawsTag website, mobile applications, QR code tags, and all related services (collectively, the "Service") operated by PeakPawsTag ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Acceptance of Terms

By creating an account, purchasing a tag, scanning a QR code, or otherwise accessing the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. We reserve the right to modify these Terms at any time. Continued use of the Service after any such modification constitutes your acceptance of the revised Terms. We will make reasonable efforts to notify users of material changes via email or in-app notification.

2. Description of Service

PeakPawsTag provides a pet identification and safety platform that includes, but is not limited to: physical tags with scannable QR codes, digital pet profiles, medical record and vaccination tracking, owner contact information management, and related features designed to help reunite lost pets with their owners.

3. Account Registration

To use certain features of the Service, you must create an account. You agree to:

(a) Provide accurate, current, and complete information during registration; (b) Maintain and promptly update your account information; (c) Maintain the security and confidentiality of your login credentials; (d) Accept responsibility for all activities that occur under your account; (e) Notify us immediately of any unauthorized use of your account.

You may register using email or through third-party authentication providers (e.g., Google OAuth). By using third-party authentication, you authorize us to access certain account information from that provider in accordance with our Privacy Policy.

We reserve the right to suspend or terminate any account at our sole discretion, with or without notice, for conduct that we determine violates these Terms or is harmful to the Service or other users.

4. QR Code Tags and Activation

Each PeakPawsTag product contains a unique QR code linked to a digital pet profile. Upon activation, the tag is associated with your account. You acknowledge that:

(a) Tags are intended for use on pets and companion animals only; (b) You are responsible for the accuracy and completeness of all information in your pet's profile; (c) QR codes are designed to be publicly scannable, and any information you designate as publicly visible on your pet's profile may be viewed by anyone who scans the tag; (d) We are not responsible for physical damage to, loss of, or tampering with tags after purchase; (e) The functionality of QR code scanning depends on third-party devices and applications over which we have no control.

5. User Content and Data

"User Content" means any information, data, text, photographs, images, or other materials you upload, submit, or transmit through the Service, including but not limited to pet profiles, medical records, vaccination records, photographs, and contact information.

By submitting User Content, you grant PeakPawsTag a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, display, and otherwise exploit such User Content in connection with the operation, promotion, and improvement of the Service, including for the purposes of:

(a) Providing, maintaining, and improving the Service; (b) Developing new products, features, and services; (c) Conducting research, analytics, and data analysis; (d) Generating aggregated, anonymized, or de-identified data sets; (e) Marketing, advertising, and promotional activities; (f) Any other lawful business purpose.

This license survives termination of your account with respect to aggregated, anonymized, or de-identified data. You represent and warrant that you own or have the necessary rights to all User Content you submit and that such content does not infringe upon the rights of any third party.

6. Acceptable Use

You agree not to:

(a) Use the Service for any unlawful purpose or in violation of any applicable law or regulation; (b) Upload false, misleading, or fraudulent information; (c) Attempt to gain unauthorized access to the Service, other accounts, or any related systems or networks; (d) Interfere with or disrupt the Service or servers or networks connected to the Service; (e) Use automated means (bots, scrapers, crawlers) to access or collect data from the Service without our express written consent; (f) Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Service; (g) Use the Service to transmit any viruses, malware, or other harmful code; (h) Impersonate any person or entity or misrepresent your affiliation with any person or entity; (i) Use the Service in any manner that could damage, disable, overburden, or impair the Service.

7. Intellectual Property

The Service and its original content, features, and functionality (excluding User Content) are and shall remain the exclusive property of PeakPawsTag and its licensors. The Service is protected by copyright, trademark, and other intellectual property laws. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent. The PeakPawsTag name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of PeakPawsTag.

8. Third-Party Services

The Service may contain links to or integrations with third-party websites, services, or applications that are not owned or controlled by PeakPawsTag. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party services. You acknowledge and agree that PeakPawsTag shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of any third-party services.

9. Purchases and Payments

Certain aspects of the Service may require payment. By making a purchase, you agree that:

(a) You are authorized to use the payment method provided; (b) All payment information you provide is accurate and complete; (c) All purchases are final and non-refundable unless otherwise stated in our refund policy or required by applicable law; (d) Prices are subject to change without notice.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, PEAKPAWSTAG DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WITHOUT LIMITING THE FOREGOING, PEAKPAWSTAG DOES NOT WARRANT THAT:

(A) THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; (B) THE RESULTS OBTAINED FROM USE OF THE SERVICE WILL BE ACCURATE OR RELIABLE; (C) THE SERVICE WILL RESULT IN THE RECOVERY OR RETURN OF ANY LOST PET; (D) ANY ERRORS IN THE SERVICE WILL BE CORRECTED.

YOU ACKNOWLEDGE THAT PEAKPAWSTAG IS A TOOL DESIGNED TO ASSIST IN PET IDENTIFICATION AND DOES NOT GUARANTEE THE SAFE RETURN OF ANY PET. THE USE OF THE SERVICE DOES NOT REPLACE RESPONSIBLE PET OWNERSHIP PRACTICES.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PEAKPAWSTAG, ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, PARTNERS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

(A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (C) ANY CONTENT OBTAINED FROM THE SERVICE; (D) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT; (E) THE LOSS, INJURY, OR DEATH OF ANY PET, REGARDLESS OF WHETHER PEAKPAWSTAG HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL PEAKPAWSTAG'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE AMOUNT YOU HAVE PAID TO PEAKPAWSTAG IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE LIABILITY.

12. Indemnification

You agree to defend, indemnify, and hold harmless PeakPawsTag, its directors, officers, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including but not limited to attorney's fees) arising from:

(a) Your use of the Service; (b) Your violation of these Terms; (c) Your violation of any rights of a third party; (d) Any User Content you submit through the Service.

13. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms. Upon termination:

(a) Your right to use the Service will immediately cease; (b) We may delete your account and all associated data; (c) Any QR codes linked to your account may be deactivated; (d) Provisions of these Terms that by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnification, and limitations of liability.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of North Carolina, United States, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good faith negotiation. If negotiation fails, the dispute shall be resolved through binding arbitration administered in accordance with the rules of the American Arbitration Association, with proceedings conducted in the State of North Carolina. You agree to waive any right to a jury trial or to participate in a class action.

15. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable.

16. Entire Agreement

These Terms, together with the Privacy Policy and any other legal notices or agreements published by PeakPawsTag on the Service, constitute the entire agreement between you and PeakPawsTag concerning the Service and supersede all prior or contemporaneous agreements, communications, and proposals, whether oral or written, between you and PeakPawsTag.
